1. Our offers are subject to our availability: no order will be deemed accepted unless approved by management.
2. Delivery lead times and the dimensions and weights specified in the offer are indicative only. Under no circumstances shall any delays in delivery be grounds for damages or interest payable by us unless expressly agreed otherwise.
3. Our goods are deemed delivered upon being made available to the purchaser or, if shipped, upon leaving our premises. Following this, all risks are transferred to the purchaser.
4. Our goods and services are deemed to be accepted unless a complaint is made in writing within five working days of delivery or, if shipped, of arrival of the goods at the address specified by the purchaser. Any return of goods must not incur any transport costs for us.
5. Invoices issued by us cannot be paid on credit, net of any discount, and are payable in our premises on the date of issue, unless expressly agreed otherwise. Any taxes are payable by the client.
6. Invoices that remain unpaid by the due date shall automatically be increased by interest on arrears of 1% per month, without the need to provide prior notice, with each month started being considered a full month. In addition, any sum that remains unpaid eight days after notice has been sent shall be increased by a penalty fee agreed between the parties of 20% of the sum due, with a minimum of 50 euros, under a fixed and irreducible penalty clause.
7. Our guarantee on goods sold is limited exclusively to that of our suppliers and to a maximum of the value of the goods delivered, according to their degree of wear, excluding any damages or interest, or the guarantee of any recourse from injured third parties. This clause applies to our contractual liability and to liability under Articles 1382 to 1385 bis of the Civil Code. The guarantee does not cover deterioration due to improper usage of over- or under-inflated tyres. It is up to the purchaser to verify that the mounting nuts or bolts are properly tightened and that the tyre pressures are correct, after 30 and 100 km of driving following the fitting of the tyres onto the vehicle. We shall under no circumstances be liable for the loss of hubcaps. Our guarantee for tyre fitting services is subject to the installation of a new inner tube or, for tubeless tyres, new valves.
8. We are only responsible for vehicles entrusted to us for services if they were brought within and collected from our premises during their normal opening hours.
Under no circumstances may we be held liable for the disappearance of or damage to goods or other objects located in vehicles entrusted to us.
Similarly we are not responsible for works requested directly from our staff unless approved by management. This clause applies even in cases of gross negligence or deceit by our staff.
9. The client agrees to take delivery of the vehicle entrusted to us for works on the agreed date. Failing this, it is expressly agreed by the parties that any risks will be transferred to the client, subject to storage costs that we are entitled to invoiced to the client.
Winter or summer tyres that we are storing in our storage sites for the client for six months shall be deemed abandoned at the end of the six-month period unless the client has taken possession of them within 20 days of the sending of a registered letter inviting the client to do so.
10. Any disputes shall fall within the exclusive jurisdiction of the courts of our registered office, unless when acting as plaintiff, we prefer to appeal to another competent court. There shall be no departure from this jurisdiction clause even in the event of multiple defendants, related cases, incidental claims or warranty claims, nor in the event of acceptance of settlement, bills of exchange or any other method of payment which, by express agreement, do not entail novation, nor in the event of carriage paid.
11. Our sales and commercial operations are exclusively subject to Belgian law and commercial practices in Brussels, in so far as this does not run counter to these general conditions.
